The law on permanent exclusion can be complex.  It has to be interpreted by an appeal panel who have no formal legal background.

This is what we can do for your Authority

Recruit suitably qualified panel members who have no connection with the school from the list held by the local authority, but we do insist on knowing that they are Code compliant with their training. Liaise with all parties for a convenient date.

Send out an invitation letter to the parent/carer inviting and encouraging them to attend the hearing.  The letter includes some advice about the hearing, an agenda, as well as who will be sitting on the panel. We would also advise the appellant where they can seek free advice both locally and nationally.  We would also send a copy of the relevant section of the Exclusion Code.

Send out all the paperwork to the parents and the panel.

a Liaising at all times with the Local Authority’s Exclusion Officer.

a If needed, give independent advice to parents.

a The Clerk will attend the hearing.  Ensure a smooth operation which is Code compliant, take contemporaneous notes, offer procedural and legal advice to the panel, record the decision, the reason for the decision and voting.

a Decisions will be e mailed to the Local Authority and the school by the next working day.

Within 48 hours of the deliberation, the Clerk will send out the decision letter to the parent(s) and a copy will be e mailed to the Exclusion Officer for the Admission Authority, together with a copy for the Headteacher of the school involved.

We will produce detailed minutes of the hearings, which will be signed by the panel Chair.

a Finally a file will be produced complete with copies of all letters, notes and minutes for the Authority to archive for five years
